Son instrumentos que las partes<!-- [et_pb_line_break_holder] -->          otorgantes suscriben en el oficio y los retiran para los fines que han sido otorgados.<!-- [et_pb_line_break_holder] -->        <\/pee><!-- [et_pb_line_break_holder] -->        <pee><!-- [et_pb_line_break_holder] -->          A este tipo de actuaciones corresponden aquellos como: cartas poder, declaraciones juradas, autorizaciones de viaje,<!-- [et_pb_line_break_holder] -->          salvoconductos, aceptaci\u00f3n de letras o suscripci\u00f3n de pagar\u00e9s, compraventa sobre veh\u00edculos motorizados,<!-- Esta voluntad debe constar en escritura p\u00fablica o privada autorizada por Notario P\u00fablico. Ellos son: los padres, tutores, el padre que concurri\u00f3 al reconocimiento, subsidiariamente el tribunal competente, o el tercero o padre que goza del r\u00e9gimen de visitas.<\/pee><!-- [et_pb_line_break_holder] --><!-- [et_pb_line_break_holder] -->        <\/p>\n<ul><!-- [et_pb_line_break_holder] -->          <\/p>\n<li>Si la tuici\u00f3n de un menor no ha sido confiada a alguno de sus padres ni a un tercero, no podr\u00e1 salir sin la autorizaci\u00f3n de ambos padres. Confiada la tuici\u00f3n a uno de los padres o a un tercero, el menor no podr\u00e1 salir sino con la autorizaci\u00f3n de aquel a quien se hubiere confiado.<\/li>\n<p><!-- [et_pb_line_break_holder] -->          <\/p>\n<li>La salida del pa\u00eds de un menor debe ser autorizada por quien lo hubiere reconocido, o por el padre y la madre si ambos lo hubieren hecho. Si la tuici\u00f3n hubiese sido confiada por el juez a uno de los padres o a un tercero, s\u00f3lo se requerir\u00e1 la autorizaci\u00f3n de aquel o de \u00e9ste, en su caso.<\/li>\n<p><!-- [et_pb_line_break_holder] -->          <\/p>\n<li>Si el tribunal decret\u00f3 derecho de visitas, tambi\u00e9n se requerir\u00e1 la autorizaci\u00f3n del padre o madre que tenga ese derecho.<\/li>\n<p><!-- [et_pb_line_break_holder] -->          <\/p>\n<li>El permiso deber\u00e1 prestarse por escritura p\u00fablica o escritura privada autorizada por Notario P\u00fablico. Este permiso no ser\u00e1 necesario si el menor sale del pa\u00eds en compa\u00f1\u00eda de la persona o personas que deben prestarlo.<\/li>\n<p><!-- [et_pb_line_break_holder] -->          <\/p>\n<li>En caso de que no pudiere otorgarse o sin motivo plausible se negare la autorizaci\u00f3n, podr\u00e1 ser otorgada por el Tribunal de Familia del lugar de residencia del menor.<\/li>\n<p><!-- [et_pb_line_break_holder] -->          <\/p>\n<li>En los dem\u00e1s casos, se requerir\u00e1 la autorizaci\u00f3n del Tribunal de Familia respectivo.<\/li>\n<p><!-- [et_pb_line_break_holder] -->        <\/ul>\n<p><!-- [et_pb_line_break_holder] --><!-- [et_pb_line_break_holder] -->        <pee><strong>Salida de menores extranjeros<\/strong><\/pee><!-- [et_pb_line_break_holder] -->        <\/p>\n<ul><!-- [et_pb_line_break_holder] -->          <\/p>\n<li>El extranjero menor de 18 a\u00f1os que ingresa al pa\u00eds en calidad de turista, con autorizaci\u00f3n escrita de su padre, madre, guardador o juez competente, se entiende facultado para abandonar el territorio nacional en virtud de esa misma autorizaci\u00f3n.<\/li>\n<p><!-- [et_pb_line_break_holder] -->          <\/p>\n<li>El extranjero menor de 18 a\u00f1os que ingresa en calidad de turista en compa\u00f1\u00eda de su representante legal, para salir del pa\u00eds sin \u00e9ste, requiere autorizaci\u00f3n escrita.<\/li>\n<p><!-- [et_pb_line_break_holder] -->          <\/p>\n<li>Si las personas llamadas a dar su autorizaci\u00f3n no pudieren o no quisieren otorgarla, \u00e9sta podr\u00e1 ser suplida por el Tribunal de Familia competente. Igual procedimiento se aplica respecto de los menores que ingresan ilegalmente al pa\u00eds.<\/li>\n<p><!-- [et_pb_line_break_holder] -->          <\/p>\n<li>Trat\u00e1ndose de extranjeros menores de 18 a\u00f1os residentes en el pa\u00eds, se estar\u00e1 a lo dispuesto en la Ley 16.618.<\/li>\n<p><!-- [et_pb_line_break_holder] -->        <\/ul>\n<p><!-- [et_pb_line_break_holder] --><!-- [et_pb_line_break_holder] -->        <pee><strong>Origen y objetivo del acuerdo<\/strong><\/pee><!-- [et_pb_line_break_holder] -->        <pee>Este acuerdo fue suscrito el 8 de junio de 2006, en el marco de la Reuni\u00f3n de Ministros del Interior del MERCOSUR y Estados Asociados, bloque en el cual Chile participa como Estado Asociado. Su objetivo es establecer un procedimiento de control que posibilite un mayor resguardo de los menores nacionales o residentes que transiten por los Estados Partes y Asociados del MERCOSUR.<\/pee><!-- [et_pb_line_break_holder] --><!-- [et_pb_line_break_holder] -->        <pee>El acuerdo rige para los siguientes pa\u00edses:<\/pee><!-- [et_pb_line_break_holder] -->        <\/p>\n<ul><!-- efectos conforme a la Ley 18.092.<\/div>\n<p><!-- [et_pb_line_break_holder] -->        <\/div>\n<p><!-- [et_pb_line_break_holder] -->        <\/p>\n<div class=\"nsjT-toggle\" aria-hidden=\"true\">+<\/div>\n<p><!-- [et_pb_line_break_holder] -->      <\/div>\n<p><!-- [et_pb_line_break_holder] -->      <\/p>\n<div class=\"nsjT-content\" aria-hidden=\"true\"><!-- [et_pb_line_break_holder] -->        <pee>Este es un tr\u00e1mite normado en la Ley 18.092. Una letra puede ser protestada por falta de aceptaci\u00f3n, por falta de fecha de aceptaci\u00f3n o por falta de pago, siendo esta \u00faltima la situaci\u00f3n m\u00e1s frecuente.<\/pee><!-- [et_pb_line_break_holder] --><!-- [et_pb_line_break_holder] -->        <pee>El protesto debe hacerse por un notario, pudiendo actuar un Oficial de Registro Civil en aquellas comunas en que no exista oficio notarial.<\/pee><!-- [et_pb_line_break_holder] --><!-- [et_pb_line_break_holder] -->        <pee><strong>Lugar del protesto:<\/strong> la letra se protesta en el lugar donde debe efectuarse el pago.<\/pee><!-- [et_pb_line_break_holder] --><!-- [et_pb_line_break_holder] -->        <pee><strong>Entrega del aviso:<\/strong> el notario debe entregar, en los lugares y oportunidades que se\u00f1alan los art\u00edculos 68 y 69 de la Ley 18.092, un aviso dirigido al aceptante, cit\u00e1ndolo para el d\u00eda siguiente h\u00e1bil que no fuere s\u00e1bado a su oficio, a fin de realizar el requerimiento correspondiente. Si el citado no comparece, se efect\u00faa el protesto.<\/pee><!-- [et_pb_line_break_holder] --><!-- [et_pb_line_break_holder] -->        <pee><strong>Acta de protesto:<\/strong> se estampa en una hoja anexa al dorso del respectivo documento. En ella se deja constancia del env\u00edo del aviso, relaci\u00f3n de lo actuado, impuestos que afectan al protesto, derechos notariales cobrados, fecha, hora, lugar del protesto y firma del notario.<\/pee><!-- [et_pb_line_break_holder] --><!-- [et_pb_line_break_holder] -->        <pee><strong>Bolet\u00edn de Informaciones Comerciales:<\/strong> el notario debe enviar una n\u00f3mina con las diligencias de protesto efectuadas.<\/pee><!-- [et_pb_line_break_holder] --><!-- [et_pb_line_break_holder] -->        <pee><strong>Oportunidad para protestar:<\/strong> en los protestos por falta de pago, el aviso debe entregarse en el lugar del pago el primero o segundo d\u00eda h\u00e1bil siguiente, que no fuere s\u00e1bado, al vencimiento de la letra. Sin embargo, se le denomina as\u00ed como una forma de entender que \u201csirve para todo\u201d, o mejor dicho, \u201cpara casi todo\u201d.<\/pee><!-- [et_pb_line_break_holder] -->        <pee>En el fondo, consiste en una enunciaci\u00f3n pormenorizada de cada una de las facultades que el mandante confiere al mandatario.<\/pee><!-- [et_pb_line_break_holder] -->        <pee>Un dato importante a considerar es que nunca un mandato debe entenderse que contiene m\u00e1s facultades que las que expresamente se han otorgado.<\/pee><!-- [et_pb_line_break_holder] -->        <pee>Se otorga por [et_pb_line_break_holder] -->        <pee>En la actualidad, gran parte de los contratos sobre compraventa de inmuebles contempla el tr\u00e1mite de dejar en custodia del notario dinero o documentos, como vales vista o cheques, mediante los cuales el comprador paga el precio de la venta.<\/pee><!-- [et_pb_line_break_holder] --><!-- [et_pb_line_break_holder] -->        <pee>Estos dineros o valores quedan bajo la custodia del notario con una carta de instrucciones en la cual se se\u00f1ala que el ministro de fe proceder\u00e1 a entregarlos a su destinatario, el vendedor o quien lo represente, solo una vez que se le acredite que el dominio ha sido inscrito a favor del comprador y que la propiedad se encuentra libre de grav\u00e1menes y prohibiciones.<\/pee><!-- [et_pb_line_break_holder] --><!-- [et_pb_line_break_holder] -->        <pee>La carta de instrucciones debe ser muy bien redactada, pues no corresponde al notario interpretar el alcance que los otorgantes han querido darle.<\/pee><!-- [et_pb_line_break_holder] --><!-- [et_pb_line_break_holder] -->        <pee>Otra caracter\u00edstica es que debe ser suscrita por todas las partes de la escritura.<\/pee><!-- [et_pb_line_break_holder] -->      <\/div>\n<p><!-- [et_pb_line_break_holder] -->    <\/div>\n<p><!-- [et_pb_line_break_holder] --><!-- [et_pb_line_break_holder] -->    <!-- 10 --><!-- <\/p>\n<div class=\"nsjT-content\" aria-hidden=\"true\"><!-- [et_pb_line_break_holder] -->        <pee>Cualquier persona residente en pa\u00eds extranjero, sea chilena o de la nacionalidad del respectivo pa\u00eds, puede otorgar instrumento p\u00fablico o privado respecto de actos o contratos que hayan de tener efecto en Chile.<\/pee><!-- [et_pb_line_break_holder] --><!-- [et_pb_line_break_holder] -->        <pee>Para ello deben concurrir al Consulado de Chile en el pa\u00eds respectivo o ante un notario del lugar.<\/pee><!-- [et_pb_line_break_holder] --><!-- Cada notario adopta las medidas de resguardo que estima pertinentes.<\/pee><!-- [et_pb_line_break_holder] --><!-- [et_pb_line_break_holder] -->        <pee>Con todo, peri\u00f3dicamente se discute en tribunales si la expresi\u00f3n \u201cautorizo la firma de\u201d es suficiente para dar m\u00e9rito ejecutivo al documento respectivo.<\/pee><!-- [et_pb_line_break_holder] --><!-- [et_pb_line_break_holder] -->        <pee>La Corte Suprema, en sentencia de 31 de mayo de 2007, rol 4721-04, rechaz\u00f3 la interpretaci\u00f3n seg\u00fan la cual el notario s\u00f3lo podr\u00eda autorizar firmas estampadas en su presencia o registradas previamente en la notar\u00eda.<\/pee><!-- [et_pb_line_break_holder] --><!-- [et_pb_line_break_holder] -->        <pee>El fallo se\u00f1ala que el requerimiento legal no va m\u00e1s all\u00e1 del texto del art\u00edculo 401 N\u00b0 10: se exige que la firma sea autorizada por notario, lo que dice relaci\u00f3n con la autenticidad de la firma del suscriptor.<\/pee><!-- [et_pb_line_break_holder] --><!-- [et_pb_line_break_holder] -->        <pee>Asimismo, la sentencia precisa que el concepto de \u201cautorizaci\u00f3n notarial\u201d debe entenderse en su sentido procesal, como la legalizaci\u00f3n que pone el ministro de fe en un instrumento, dando fe p\u00fablica de la verdad de las firmas puestas en \u00e9l.<\/pee><!-- [et_pb_line_break_holder] --><!-- [et_pb_line_break_holder] -->        <pee>Por ello, el vocablo \u201cautorizar\u201d no supone necesariamente la presencia del suscriptor ante el notario, bastando que al ministro de fe le conste la autenticidad de la firma que autoriza. Esta interpretaci\u00f3n resulta coherente con el art\u00edculo 401 N\u00b0 10 del C\u00f3digo Org\u00e1nico de Tribunales y ha sido reiteradamente acogida por la jurisprudencia nacional.<\/pee><!--
